Terms of Service

In these Terms of Service:
- ‘Underscar’, “we” or “us” means Underscar Owners’ Club Limited (CRN:09734440) whose registered office is at Underscar, Applethwaite, Keswick, Cumbria, CA12 4PH.
- ‘Terms of Service’ means the Terms of Service (including the definitions) set out in this document and which apply to your Let.
- ‘you’ means the person or persons entering into this agreement.
Rental Price Agreement:
- The prices shown in the Details of Letting email are indicative and may not represent the actual price we achieve. We retain the exclusive right to set and adjust the prices for all listings on our website or third-party platforms with whom we engage on your behalf. Property owners agree to delegate the authority to us to determine final listing prices, including any discounts, promotions, or special offers.
Deductions from Rental Income:
- From the agreed rental price, the following deductions will be made:
  - Commission of 20% plus VAT.
  - Fuel bills for gas and electricity used by the renters, as detailed in Note 1 below.
DAC7 Reporting
- In accordance with the DAC7 regulation, we are required to report certain rental income data to the tax authorities. Specifically, if you have had 30 or more rental bookings or earned approximately £1,700 or more from rentals through our platform in a calendar year, we must share your sales data with the tax authorities.
- For the purpose of determining whether the earnings threshold is met, the following amounts are deducted from your gross rental income:
  - Agency fees (commission)
  - Guests’ fuel bills
  - Additional cleaning charges
- The net amount after these deductions will be used to assess whether the £1,700 threshold has been reached. Management fees are not deducted for this calculation, as they are considered an expense of the property rental and not directly related to the facilitation of the rental activity through our platform.
- If your rental activity meets either of the above criteria, your rental income will be reported. This reported income may affect your tax obligations, and we recommend consulting with a tax professional to understand the implications for your personal tax situation.
- Data Retention
  - To comply with our legal obligations under the Platform Operators (Due Diligence and Reporting Requirements) Regulations 2023 (the UK implementation of the OECD digital platform reporting rules, aligned with DAC7), we retain the personal data we collect from you in connection with these reporting requirements, including your identification details, rental activity, income information, and any supporting records, for 5 years following the end of the calendar year to which the data relates.
    This retention period allows us to respond to any enquiries or audits from HMRC and to demonstrate that we have correctly applied the reporting rules (including for owners who fall below the reporting threshold). After this 5-year period, we will securely delete or anonymise your data in line with our Privacy Policy and the UK GDPR, unless we are required to retain it longer for another lawful reason.

Short Breaks:
- We may split your week into shorter breaks, which may incur additional charges. If two short breaks are successfully accommodated, an additional mid-week cleaning charge will be deducted.
No Booking, No Charge:
- No charge will be made if we are unable to secure a booking for your property.
Management Fees:
- You remain responsible for the payment of your management fees per the Articles of Association and Rules and Regulations of Underscar Owners’ Club Limited, as detailed in Note 2 below.
Booking Notifications:
- Confirmed bookings will be notified during office opening hours. You are welcome to contact us at any time for updates.
Cancellation of Agreement:
- Written confirmation from you is required to cancel this agreement. All bookings taken prior to cancellation are binding. We will actively market your week until the arrival date has passed. If you wish to use or bank your week with 7Across, you must notify us during office hours so that we can remove your week from our rental site.
Commencement of Marketing:
- Marketing of your week will commence only after we receive your agreement to these Terms of Service.
Notes
1. Fuel Bills
  - For holidays taken from 1st January 2025 onwards, the owner of the relevant week will be responsible for paying the renters’ fuel bills. These amounts will be automatically deducted from your rental income and are capped as follows:
    - 1 bedroom property: £80
    - 2 bedroom property: £90
    - 3 bedroom property: £100
  - The above fuel caps include VAT. If the renters’ fuel bills exceed these amounts, Underscar Owners’ Club Limited will cover the difference.
2. Annual Maintenance Fees
  - Owners must comply with the payment terms for the annual maintenance fees as stated in the Rules and Regulations of Underscar Owners’ Club Limited. Failure to pay the fees on time may result in withholding property keys, charging interest on overdue payments, and withholding marketing services for your property.
General Conditions:
- Underscar Owners’ Club Limited reserves the right to amend these Terms of Service or withdraw its services at any time without prior notice.
- Any disputes regarding these Terms of Service will be resolved at the sole discretion of Underscar Owners’ Club Limited.
Privacy:
- Personal information collected as part of the letting process will be used in accordance with the privacy policy of Underscar Owners’ Club Limited.
- You consent to the use of your information for the purpose of administration.
